These terms and conditions (hereinafter, “the Terms”) govern access, use and liability of the website operated by ARTE KAYA S.A. DE C.V. (hereinafter, “ARTE KAYA” or “the Gallery”), as well as the services, content and products offered through it.
By accessing ARTE KAYA‘s website (hereinafter, “the Site”), the user (hereinafter, “the User” or “the Client”) agrees to be bound by these Terms.
2. Acceptance of the Terms
Access to and use of the Site implies full and unconditional acceptance of these Terms. If the User does not agree with them, they must refrain from using the Site and the services offered by ARTE KAYA.
3. Purpose of the Service
ARTE KAYA offers through the Site various services related to the activity of an art gallery, including but not limited to the following:

Images of artworks are digital representations and may differ from the physical piece.

These Terms will be effective from the moment the User accesses the Site and will remain in effect until modified or terminated by ARTE KAYA.

ARTE KAYA may modify, suspend or discontinue any service, content or product of the Site without prior notice. Prices of works and products may change at any time.
The User accepts that ARTE KAYA will not be liable for such modifications.

The User agrees to indemnify and hold ARTE KAYA harmless from any claim, damage, loss or expense (including legal fees) arising from the breach of these Terms or the misuse of the Site.
14. Applicable Law and Jurisdiction
These Terms shall be governed by the laws of Mexico. For any dispute, the parties submit to the competent courts of Mexico City, waiving any other jurisdiction that may apply to them.
15. Privacy Notice
ARTE KAYA protects the User‘s personal data in accordance with its Privacy Notice and the Federal Law on Protection of Personal Data Held by Private Parties. The use of the Site implies acceptance of the processing of data in accordance with said Notice.
16. Modifications to the Terms
ARTE KAYA may modify these Terms at any time. Modifications will be effective from their publication on the Site. It is the User‘s responsibility to periodically review the current Terms.
17. Termination
ARTE KAYA may suspend or terminate access to the Site at any time and without liability, especially in the event of the User‘s breach of these Terms.
